1. Pursuant to art. 64 and following of Legislative Decree no. 206/2005, if the customer is a consumer (i.e. a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number reference in the order form), is entitled to withdraw from the purchase contract for any reason within 30 days of receipt of goods, without any penalty and without prejudice to what is indicated in point 3 below.

2. To exercise this right, the customer must enter a withdrawal request in which it will also be necessary to indicate the bank details necessary to return the sums paid; the system will send the customer via email a paper form which must be printed and sent by registered letter with acknowledgment of receipt within 14 days from the date of receipt of the goods to: Openapi with headquarters in Viale Filippo Tommaso Marinetti 221 - 00143 Roma. Upon receipt of the registered letter, the form for exercising the right of withdrawal will be sent by email to the customer with an authorization number which must be attached to the outside of the envelope in which the product will be physically placed and sent to Openapi SpA.

3. The right of withdrawal is however subject to the following conditions:

• the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, attached software, etc ...);
• the right does not apply to new digital signatures when they have already been assigned to the customer (therefore the day after the customer sends the signed document as per legislation, before this time it is always possible to request the withdrawal) because the digital signature, as per legislation, being an autograph signature cannot be transferred or resold to third parties;
• the law does not apply pursuant to art. 48 of the Consumer Code, once Openapi has already performed the services you requested;
• the shipping costs for returning the goods are charged to the customer;
• the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
• in the event of damage to the goods during transport, the customer will be notified of the incident (within 5 working days of receipt of the goods in his warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain a refund of the asset value (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
• Openapi is not liable in any way for damage or theft / loss of goods returned by uninsured shipments;

3. Without prejudice to any restoration costs for damages ascertained to the original packaging, the amount already paid for the purchase of the goods will be refunded to the customer within 14 days of his return, by reversing the amount charged on the Credit card or by bank transfer. In the latter case, the customer will promptly provide the bank details on which to obtain the refund (IBAN and Bank code of the invoice holder).

4. The right of withdrawal is lost for lack of the essential integrity of the property (packaging and / or its contents), in cases where it is ascertained:

• the lack of the external packaging and / or the original internal packaging;
• the absence of integral elements of the product (accessories, cables, manuals, parts, ...);
• damage to the product for reasons other than its transport.
